Green Blog: A Price Tag for the Gowanus Cleanup

The Superfund cleanup of the Gowanus Canal in Brooklyn is expected to cost $467 million to $504 million and will require dredging the 1.8-mile waterway to remove contaminated sediment, the federal Environmental Protection Agency said on Thursday.

The agency, releasing an updated plan for public comment, is also proposing controls to prevent raw sewage discharges by the city, which have been an ongoing source of contamination.

The worst contamination of the Gowanus however, comes from its past as a major industrial transportation route for paper mills, tanneries, chemical plants and other businesses that operated alongside it. The waterway is polluted with more than a dozen contaminants, including PCBs and heavy metals like mercury, lead and copper.

Despite the heavy contamination and government advisories against fishing, officials say that some residents continue to eat fish from the canal.

?The proposed cleanup plan for the Gowanus Canal will make essential progress in removing toxic contaminants from this heavily polluted and battered waterway,?? Judith A. Enck, the E.P.A.?s? regional administrator in New York, said in a statement. ?Our overall goal is to reduce pollution and protect the health of people who live and work in this community.?

In a phone interview, Ms. Enck said she expected the plan to be finalized by the end of next year. The design phase will then take about two years, and the cleanup itself will take until 2020, agency officials said.

?This is an area where millions of people live, and we?re going to work with the community so this is the least disruptive as possible, especially to local businesses,? Ms. Enck said.

Among the parties helping to pay for the cleanup are the city and other entities associated with the pollution of its waters, including National Grid, formerly the Brooklyn Union Gas company.

The Gowanus was added to the federal Superfund list in 2010 over the objections of the Bloomberg administration, which feared that the designation would deter development and had proposed a streamlined cleanup that it would help oversee. City officials have also clashed with the EPA over how to address the sewage overflow issue, given the costs the city would incur in seeking to address it.

But on Thursday, the city?s Department of Environmental Protection, which handles sewage treatment, said in a statement: ?We look forward to carefully reviewing the details of E.P.A.?s proposal and working with our state and federal partners to improve water quality and support the cleanup of the canal.?

The E.P.A.?s plan involves dividing the canal into three segments. For the first two, more heavily contaminated segments, the agency plans to dredge or ?stabilize? the sediment in some areas by mixing it with concrete or a similar material and then capping it with layers of clay, sand and gravel.
The third segment would be dredged and capped with sand, the agency said.

To prevent recontamination after the cleanup is completed, federal officials are also proposing installing controls at two major city outfall sites that discharge sewer overflows into the canal. The controls ? basically, holding tanks that would retain excess sewage and stormwater until the city?s treatment plants can handle it ? could reduce discharges of raw sewage by
58 percent to 74 percent, the agency said.

Two public meetings on the cleanup plan are scheduled, on Jan. 23 and 24, and the E.P.A. is accepting public comments until March 28. Written comments on the proposed plan should be addressed to:

A Newbie's Guide to Launching an Internet Marketing Business in ...

Hi everyone! One of the most common questions we get asked (those of us making pretty good money online) is, ?If you had to start over from scratch, what would you do??

It?s primarily the newbies who want to know this ? or those who have been trying without success for quite awhile and can?t be classified as newbies anymore.

So I wanted to share my exact blueprint of what I would do if I logged on today and didn?t know how to navigate the world of Internet Marketing.

Mindset First

Before we can DO, we have to BELIEVE. And I don?t mean wishful thinking and crossing fingers and all that jazz. I mean, you can?t go into this with a failure?s mindset. I did that the first time around.

I wasn?t good enough or smart enough or knowledgeable enough to compete with the big guys, so it took me six years to gain the confidence I needed to actually succeed.

I don?t care what you have to do ? look at yourself in the mirror and recite the motto from The Help:

The Help

I don?t care if you download a positive affirmations app or stick a sticky note on your forehead that says, ?I can DO it!?

But let me explain this clearly ? if you go into this business with a mealy mouthed, timid, self defeating, wimpy mindset ? You. Will. Fail.

Or at the very least it?ll take you years to succeed, and then you?ll be kicking yourself for not listening to me in the first place.

Confidence is also attractive ? not just in the dating scene, but in business, too. No one wants to trust someone who can?t even trust themselves! So even if you have to take a deep breath and project confidence for 1-2 hours a day while you work, DO it.

Forget About BIBs

When I first started trying to break out of my ghostwriting role and into Internet Marketing, I was on the hunt for a good Business in a Box. Something I could pay for, download, open like a Christmas gift, and push a button to launch.

Not only does nothing work like that, but I look back and think, ?Thank God it didn?t work like that!? There?s no FUN in a BIB!

I like to picture myself as some crazy woman in a frayed smock with mud and paint flying all over the place. I?m an artist! I create the business I want based on what I want it to look like ? on what I think is wonderful.

Internet Marketing

Doesn?t she look like she?s having fun? She is. She?s not freaking out about a mess or colors mixing up. She?s just free and doing what she wants to do and enjoying it.

I might not have a straight line from point A to point B in my business. Hell, I might squiggle all over the map. Sometimes my line might abruptly end if I toss a business model aside. But it?s MY journey and there IS no right or wrong. It just is what it is.

Part of what is going to help you become an awesome business person online is that you will go through your process with some successes and some failures. You?ll know what works and what doesn?t. You?ll have the courage to tweak and Frankenstein it to your own.

That?s what leaders are made of ? courage to fall, but strength to get back up again.

Marvel at Your Options

Once I had the right mindset and realized I was about to create a brand new business model based on my own tastes and preferences, I would see what all I have available to me out there ? create my paint pallet, if you will.

There would be more than 1. I wouldn?t start with one business model. I would start with at LEAST two, probably even 3-4.

?But that would be overwhelming!? some will say. No more so than one business model to me. You don?t go plant a garden with one vegetable. You plant rows of different things. Some will flop. Some will thrive.

I would personally do many things at once. Bite-sized chunks. You?ll get excited seeing success in some areas, feeling okay letting others go (that don?t sprout for you).

Imagine if you invested months into one business model and never saw any success. How depressing! But if you have 4 going and 2 out of 4 were succeeding, you?d still be excited.

Make Plans to Do Big Things

I would make plans ? not small plans ? BIG plans. Take over the world plans.

No niche leader is too big to knock off the mountain. Set your sights on him (or her). You don?t set out to climb Mount Everest and say, ?I?m just going up 10 feet.?

Pffft!

No way ? you have your sights set on that mountain peak, right? All or nothing, baby. That?s what you do in business. You decide right now that your goal is to DOMINATE. Think BIG!

Confidence

This goes back into that whole mindset thing. But it also involves actual planning. Now as a newbie, you don?t know all the steps yet. That?s okay, too!

So what you need to do is, once you learn about the various business models and pick a few you want to try, find out what the best courses are to teach you those business models.

Ask people you trust. Don?t know who to trust? Ask a whole forum full of people for a recommendation and then ? and most importantly ? do some digging yourself.

If 35 people recommend me for teaching ghostwriting in Ghostwriting Cash, don?t just trust them! Go to my blog, read what I write, email me to see if I?m the real deal, and go to Google to see if I?m a scumbag.

And don?t plan to just learn from ONE person. Be a learning addict. If and when you can afford it, download several courses on the business model and take what you want from each one, leave what you don?t agree with.

Do as much learning for free as you can if money is an issue ? and then put aside a little bit to invest in products.

IMPLEMENT them as you learn them. No reading and nodding your head. DO. Get stuck? Great ? so does everybody else who has been before you. When you get stuck, you email the product owner. If he/she doesn?t respond, then you ask in a forum and this is only AFTER you go online and look for the answer yourself.

Pick a Niche ? Your Niche

When you go to pick your niche, forget all about who says what when it comes to niches. Seriously. Don?t go asking anyone about niche saturation (I don?t believe there?s such a thing).

Don?t worry about not being an expert. A leader simply learns and shares and is appreciated by others.

The most important thing when picking a niche is to enjoy it. So don?t go into acne just because it?s a common health problem if you don?t enjoy talking about all things acne related. Don?t go into green funerals just because it?s trendy if blogging about death will make you depressed (lesson learned).

Do you have to know about the niche already? Nope.

If it?s something you?ve always wanted to learn about ? then making a business from it is thrilling ? and tax deductible (get your CPA?s advice, but many of the things you do and tools you buy to blog about in the niche can serve as write offs).

You?re going into this to make money, yes. But you are about to earn freedom ? so choose a niche that you?ll have fun in every day and wake up wanting to blog about.

And yes, that can be health. If you suffer from gout and you want to help other gout sufferers, then that can be rewarding. Making those connections with a community of like-minded people is FUN! Even if it?s a health topic.

Get Started and Tweak as You Go

If you have any pipe dreams about never making any mistakes ? or changes to your business, please clear your head of that misconception before you pursue this career.

It?s a FACT that you?ll flop here and there. It?s also a FACT that you?re going to change your mind.

Give yourself permission to do away with business models, niches, domains, and content that just doesn?t curl your toes.

No guilt.

No trashing yourself for being a quitter.

It?s called being the BOSS and making smart cuts wherever necessary and warranted. Now keep in mind that there?s a fine line between cutting out something that?s not suitable for you and literally quitting because you?re not focused or you?re too scared.

Really evaluate the reason before you whip out the machete and give something a whack.

Just keep giving to your niche. ?Come to the table ready to serve,? says my mentor. Learn it and live it.

Then gain more knowledge and grow as a leader. If you?re trying to be a leader and you don?t believe in continuing your own learning process, then just expect someone to overpower you easily ? because there will be someone out there who will be willing to go the extra mile.

Oh and by the way ? there is no specific ?start here? square on the board of the Internet Marketing game.

Everyone?s going to start in a different place. You might start by picking which products you want to promote, or writing a bunch of articles. I might start by installing my blog and getting graphics done.

So if you?re looking for a step 1, step 2, step 3 scenario ? quit looking. Just get going and you can rewind and fast forward all over the place. You have the freedom to do that.

Enjoy the journey. The messy, rollercoaster, breathtaking journey of carving out a one of a kind business that no one else in this universe will have but you.

Making Process Planning Cool Again - Sarah Green - Our Editors ...

Processes are, if not under attack, then falling out of fashion among a certain type of business cognoscenti. Planning is out. "Planning to learn" is in. Little bets, experimentation, just start, iteration, rapid prototyping, lean ? these are the cool kids. Process is the dork in the corner wearing mom-jeans and an unironic Christmas sweater.

But while it may not be cool to talk about process, I suspect I don't have to convince HBR readers of its merits ? how else to explain a post on a project management process racking up hundreds of comments? Still, the world is in need of more processes ? and more process evangelists.

Steve St. Angelo is the Chief Quality Officer for Toyota North America. I caught up with him recently, and with Zack Rosenberg, co-founder and CEO of the St. Bernard Project, a non-profit building homes in post-Katrina New Orleans (yes, seven years later, they are still rebuilding down there). Rosenberg's organization has been using Toyota's process chops to produce more houses, more efficiently. St. Angelo is as straightforward and steady as your best factory foreman; Rosenberg is a spinning top of enthusiasm. Together, they're putting roofs over people's heads.

Here's how it works. Through the Toyota Production System Support Center (TSSC), a nonprofit within the auto company, Toyota shares its TPS methods with all kinds of organizations ? including donating their expertise to other nonprofits. "So what?" you might say, "TPS is old news." And Toyota has had recall and quality issues recently. And many of the companies that implemented the TPS principles have found them difficult ? at best ? to implement. So what makes this different?

First, TSSC is choosey. They don't start working with an organization if the executive team is skittish ? at all ? about adopting TPS methods wholeheartedly. Like any good process junkies, they know a half-adopted process is as bad, if not worse, than none at all. Second, they invest for the long term. It's not just about changing the process ? it's about changing the culture. Too many processes are implemented superficially, which is why they don't work. "This is not a silver bullet," as St. Angelo cautioned me. To make it work, you need to be "obsessed." And it's not without challenges ? Rosenberg talked about how when they first started implementing TPS, with its focus on surfacing problems quickly, the organizational culture became negative. The focus on "continuous improvement" left employees feeling like whatever they were accomplishing was never good enough. As soon as one problem was solved, one inefficiency identified, it was on to the next. So Rosenberg adapted ? he started talking more about "constructive dissatisfaction," and celebrating small wins.

Another TSSC principle: The companies and nonprofits working with TSSC aren't allowed to lay anyone off. Anyone. The theory: if workers realize their jobs are safe, they're much more likely to adopt more efficient processes. Too often in business-speak, "We need to get more efficient" translates to "We need to fire some of you." No wonder people cleave to inefficiency ? they want to defend their jobs. Take that fear away, and it's much easier to get stuff done.

They start with the biggest roadblocks, first. "We go in and ask them, 'What's your largest problem?'" he said, "And we start there." That's how TSSC helped the St. Bernard Project reduce the time it took to build a house by 50%. It's how they helped the Food Bank for New York City reduce the wait at one soup kitchen from 85 minutes to 18 minutes. And it's how they decreased ER waiting times ? and hundreds of thousands of dollars in costs ? at Allegheny General Hospital in Pittsburgh.

That's what I love about a good process: It builds homes. It feeds the hungry. It heals the sick.

But what does Toyota get out of this, aside from that feel-good factor, and some (ahem) fawning media coverage? St. Angelo says they use it as talent development for more junior employees. By teaching TPS to others, they learn it better themselves. They see where the pain points are; they learn how to manage people, build trust, get buy-in, iron out the wrinkles, adapt. And, for a generation who wants more meaningful work, it's not a bad retention strategy.

Finally, as my conversation with St. Angelo was winding down, I just had to ask the question I've been secretly burning to ask this entire time: How the heck do you deal with airport security lines? As one process junkie to another ? don't they just make you unbelievably frustrated?

St. Angelo stops, looks at me. Pauses. Thinks. Then immediately starts brainstorming how he might rejigger the screening system, revamp the queuing process, and manage the flow of grey plastic bins that receive our shoes, watches, computers, and baggies full of 3-oz liquids. This guy is good.

But a good process ? that's even better.

The hallmark of Shen Yun is classical Chinese dance, an art form developed throughout 5,000 years of Chinese history. Kelley Bodanis, another former dancer and a former Miss Dance Canada, echoed Mrs. Tovey?s sentiment. ?The dancing technique is beautiful. They?re very, very graceful. The positions?the feet, arms, everything?they?re very, very, very good. One of the best I?ve seen,? she said

Jack Dheer, Rogers TV station manager and expert on all things audial and visual, was particularly impressed with the production values found in Shen Yun.

?The visuals, that just captures your eyes, it?s just beautiful. I have to tell you the music is just phenomenal. I think the orchestra is excellent. Everything, visually and the audio, it?s just absolutely beautiful,? he said.

Mr. Dheer, named Mississauga?s Citizen of the Year in 2005, has been working in television for 15 years. He reflected on the amount of work that would have to go in to produce something on the scale of Shen Yun.

In addition to a unique live orchestra, Shen Yun employs solo singers who perform using the bel canto style of singing, a style regarded by many as the pinnacle of the artistic expression of the human voice.

Tenor Marcus Saroop, who has been involved in opera and the performing arts since childhood, said Shen Yun was among the best productions he had ever seen.

?I haven?t experienced anything like [Shen Yun],? he said. ?I?ve experienced a lot of different operas, a lot of different shows, but nothing so wonderful.?

Mr. Saroop praised Shen Yun?s tenor, Yuan Qu, and soprano singers, Pi-ju Huang and Haolan Geng.
?They have great skill,? he said. ?The Chinese singers have been incredible.?

Backdrops Give New Dimensions to the Dance

Veteran animator Charles Bonifacio, who directed the animation for the original Care Bear movies in the mid-1980s and has worked on a host of other iconic animated films such as Disney?s Mulan and Tarzan II, had special appreciation for Shen Yun?s vivid high-tech animated backdrops.

?It was very fun to see the dancers jumping down and then ending up on the moon or in the rivers?very exciting. It gives another dimension to the dance,? Mr. Bonifacio said, describing the state-of-the-art animated graphics that complement and synchronize all aspects of the performance, including the characters, dance movements, and storyline.

?It gives you another dimension of space and time, and characters can come from another world or the moon and join the dancers on stage, so it gives that other spiritual dimension as well,? Mr. Bonifacio noted.

The backdrops mesmerized viewers with glimpses of completely different worlds, from a tropical beach in one dance to Himalayan peaks in another, from ancient pavilions to vast grasslands, from the picturesque Yellow River Delta to celestial palaces.

According to its website, Shen Yun?s mission is to revive 5,000 years of divinely inspired Chinese culture.

Over the last six decades, with the rise of the Communist Party in China, much of the essence of the country?s traditional culture has been lost?a culture that encompasses principles such as benevolence, justice, wisdom, propriety, and respect for the heavens.

Jeffery Klaehn, an author, editor, cultural commentator, and a professor at Wilfrid Laurier University, called Shen Yun a ?brilliant and beautiful way to bring Chinese culture to audiences.?

?Well worth the money. I?ve seen a lot of plays and musicals and this was just astounding,? he said.

Mr. Klaehn offered a sentiment that many have echoed, calling Shen Yun ?an experience I?ll remember ? we all will, for the rest of our lives probably.?

Realignment's unintended consequence: No supervision ...

The first wave of felons sent to county jails instead of state prisons under Gov. Jerry Brown's public safety realignment plan are back on the streets after serving their sentences, and local law enforcement officials are worried they will trigger a spike in crime.

Almost all of the felons are under no obligation to report to a parole agent or probation officer, and many did not get job training and other rehabilitation services while behind bars.

"Of those 9,000 who have been sentenced to jail in lieu of prison, about 90 percent of them are going to come out without supervision by a probation officer or a parole agent," county Chief Probation Officer Jerry Powers said during a recent meeting of the Southern California Association of Governments.

"They're simply going to walk out of jail a free person, and we will have no ability to compel them to engage in drug treatment, mental health treatment or anything of that sort," he added. "As soon as they hit that public sidewalk, they are truly free."

Realignment, also known as AB 109, is the governor's way of complying with a Supreme Court mandate to reduce overcrowding in state prisons.

Among the strategies for lowering the inmate population is to send most felons sentenced with non-serious, non-violent and non-sex crimes to county jails instead.

If the felons had stayed in state prisons, they would have been required by state law to report to parole agents for one or more

years after their release.

They would also have been ordered to stay away from their victims, and been subject to warrantless searches. Some might also have been compelled to undergo services to ease their re-entry into society.

Los Angeles Police Department Assistant Chief Michel Moore said realignment provided no such "safety net" for felons diverted to county jails.

"It's a pretty big omission in the statute," added Deputy District Attorney Kraig St. Pierre, in charge of the county DA's Parole Revocation Section.

But Luis Patino, a spokesman with the California Department of Corrections and Rehabilitation, noted realignment does not prevent felons from being supervised after their release from county jail, but leaves it to the decision of a judge.

"AB 109 does not inhibit judges from placing an offender on probation supervision once they leave jail," he said. "Superior Court judges are given that discretion through split sentencing."

Under split sentencing, a four-year jail term, for example, can be converted to two years behind bars and two years under probation.

According to a recent study by the Chief Probation Officers of California or CPOC, however, it is used very rarely in Los Angeles County.

Since realignment took effect in October 2011 through June 2012, only 370 out of 6,800 AB 109 felons were given split sentences.

That's only 5 percent, when most other counties in the state use split sentences at least 40 percent of the time. A few apply it to 100 percent their cases.

Moore said jail terms should automatically come with a so-called "supervision tail," which allows local law enforcement officers to keep tabs on felons who are back in the community.

"With realignment, it appears there's some kind of bargaining that has to go on, where if we want community supervision, felons have to get less time in custody," he said.

Moore, Powers, St. Pierre and Assistant Sheriff Cecil Rhambo argue there is a need for legislative fixes to AB 109 so that - at a minimum - felons released from county jail can be subjected to warrantless searches for a certain period of time.

But some key lawmakers, including state Senate President pro Tem Darrell Steinberg, oppose that idea.

"If we were to mandate a tail on jail felons, then no one would use the alternative sanctions like split sentencing that were part of the public safety realignment," said Mark Hedlund, a spokesman for Steinberg, D-Sacramento.

"The goal of realignment was to improve the system - not just to push down the same problems with overcrowding to the local level," he added. "This proposal is premature and in conflict with the overall goal of realignment."

Felons violating probation would have to be thrown back into county jail, which is already almost at full capacity because of realignment - so much so that the Sheriff's Department is thinking of outsourcing jail beds.

The overcrowding in state prisons was partly due to felons being recommitted after violating parole.

Also, though the recent approval of Proposition 30 guaranteed funding for realignment, it would not cover the additional cost of jailing AB 109 felons who violate probation.

CPOC advocated an increase in the use of split sentencing.

"When local prison offenders do not receive a split sentence they are released to the community at the end of their sentence and opportunities to change criminal behavior for this population are usually lost," it said in a brief. "Split sentencing would diminish this risk to success by incorporating supervision by the probation officer into supervision and treatment plans."

To provide felons with some re-entry programs while they are behind bars - a captive audience, so to speak - the Sheriff's Department is ramping up its Education-Based Incarceration Program, which provides vocational courses and life-skills classes.

So far, realignment has put about 9,000 felons in county jails instead of state prisons over the last 14 months. Of those, about 4,000 have been released.

Since nobody keeps track of them, it is unclear how many have committed new crimes.

St. Pierre said the governor has called these felons "lower-level offenders," but that may be a misnomer.

"Before AB 109, these people would have gone to state prison," St. Pierre said. "In L.A. County, unless you commit a big-deal crime, you generally do not get a state prison commitment on your first conviction."

He explained many of them likely amassed a significant misdemeanor record and/or juvenile record. Some may even have prior felony convictions.

Aside from the 4,000 released from county jail, there are another 12,000 AB 109 felons in Los Angeles County who finished serving their sentences in state prison but came under the less-stringent supervision of probation agents instead of parole agents.

About 3,600 of that population went to LAPD territory, where 2,800 were rearrested for various offenses and 500 absconded. At least seven were accused of murder, including Ka Pasasouk, who has been arrested on suspicion of killing of four people in Northridge.

Preliminary data on the crime rate in areas patrolled by the LAPD showed that, overall, violent crimes and property crimes still dropped between 2011 and 2012, though by only 1.2 percent.

In the previous year, the decline was 6 percent.

Property crimes, in particular, rose by 0.4 percent. That's in contrast to the previous year, before realignment, when property crime decreased almost 4 percent.

In areas patrolled by the Sheriff's Department, violent crimes increased by almost 3 percent, and property crimes by more than 4 percent, between 2011 and 2012.

The largest spike was in theft, 6.15 percent; and burglary, 3.92 percent.

Rhambo attributed those to both the struggling economy and realignment, noting "we have had thousands of people released who are pretty much drug addicts or property crime violators."

Moore said unless the AB 109 population had post-release supervision and reentry programs - whether through a supervision tail or split sentencing - the progress made over several years to reduce the crime rate could be jeopardized.

"Make no mistake about it," he said, "when 85 percent of our crime in the city of Los Angeles is property-related, offenders who are not properly reintegrated into society pose a substantial risk to us losing our decade-long decrease in crime."

Google Play Books gets high quality read aloud, pinch zoom, recommendations

If you like having your classics read to you by your handheld device but don't care for the usual robot-stuck-in-a-well tones, Google Play Books has been updated with a more dulcet option. The "read aloud" function (which has been around for several versions, despite Google saying it's new) now has a high quality voice option, which only works if you're connected to the internet. We gave it a whirl ourselves, and it's now far more tolerable to listen to "Oliver Twist" or other flowing text books, thanks to a more natural sounding voice -- as heard in the audio file after the break. In addition, Google has added pinch or double-tap zoom options, text editing features for notes, personalized recommendations and "numerous bug fixes and performance enhancements." House Speaker John Boehner makes a brief statement to the media at the Capitol in Washington December 19, 2012.??Republican House Speaker John Boehner warned President Barack Obama on Wednesday that he can either accept a GOP alternative to a comprehensive ?fiscal cliff? compromise or ?be responsible for the largest tax increase in American history.?

?I hope the president will get serious soon about providing, and working with us on, a balanced approach,? Boehner told reporters in a brief public appearance at which he took no questions.

The verbal hardball tactics came one day before the Republican-led House of Representative was to vote on the speaker?s ?Plan B," which would extend Bush-era tax cuts on income up to $1 million but raising tax rates above that. His plan also keeps in place deep automatic defense and domestic spending cuts -- the so-called sequester -- that key Republicans have spent months denouncing as unacceptable and dangerous to national security.

?Tomorrow, the House will pass legislation to make permanent tax relief for nearly every American 99.81% of the American people,? Boehner said. ?Then the president will have a decision to make: He can call on Senate Democrats to pass that bill or he can be responsible for the largest tax increase in American history.?

The speaker?s remarks hinted at the pitched public relations battle over the ?fiscal cliff? -- across-the-board income tax hikes and deep government spending cuts that will be triggered if the White House and congressional Republicans can't reach a deal. The combination of spending cuts and tax hikes could plunge the fragile economy into a new recession. Both would go into effect January 1 barring an 11th-hour compromise.

Republicans have squirmed for months in the face of opinion polls showing the public sides with Obama, who has accused the GOP of holding tax cuts that chiefly benefit the middle class hostage to secure tax cuts for the richest Americans. The president first called for extending tax cuts on income up to $250,000 annually per household, then in a concession to Republicans raised that to $400,000.

Boehner?s gambit also highlighted how he is in a political bind. Many conservatives in the House oppose any tax increase at all. On Wednesday, the anti-tax Club for Growth interest group warned House members to vote against the speaker?s plan. And some House Republicans remain opposed to the automatic defense cuts they say risk endangering national security.

But it?s also not lost on anyone that Boehner?s ?Plan B? could turn out to the be the legislative vehicle for any final compromise deal. Once received by the Senate, lawmakers there could amend the package and send it back to the House ? though that may be easier said than done.

In some ways, Obama seems to be playing along with the idea that the time for talking is over and its now time to vote. During a press conference at the White House shortly before Boehner's comments, the president signaled that he was done negotiating. ?Take the deal,? he said.

As for a negotiated compromise? ?I think the Speaker would like to get that done,? Obama said.

Oncothyreon lung cancer trial disappoints; stock plummets

Oncothyreon Inc. announced disappointing results of a trial of its lung cancer drug and shares in the Seattle biotech plummeted on the news.

Oncothyreon (NASDAQ: ONTY) said a clinical trial of its L-BLP25 drug known as START "did not meet its primary endpoint of an improvement in overall survival in patients with unresectable, locally advanced stage IIIA or stage IIIB non-small cell lung cancer (NSCLC)."

Shares in Oncothyreon plunged more than 55 percent in early Wednesday trading, falling $2.50 to $2.00.

"These results from the START trial are disappointing, both for patients with NSCLC and for the many who have been involved in the L-BLP25 program," said Dr. Robert Kirkman, president and CEO of Oncothyreon, in a statement.

Phase in Debt Limit

Everyone in Washington, D.C. knows two things:

1. President Obama will try to wriggle out of any spending cuts enumerated in the fiscal cliff deal. We all know from experience that whenever there is a one-to-one ratio between spending cuts and revenue increases the ratio falls apart in reality. The tax increases slow the economy, curtailing growth and increasing entitlement spending. Unless there is an enforcement mechanism, spending goes up, not down.

2. The Republicans will not refuse to raise the debt limit and thus cause the nation to default. If House Speaker John Boehner did not let the government shut down over the 2011 continuing resolution battle or the subsequent debt limit fight, he won?t let it close down now.

So, as things now stand, any leverage the Republicans get from the debt limit fight is purely theoretical and not real.

Here?s how to make it real:

The Republicans should offer to pass a bill setting a debt limit that rises each quarter pegged to one-third of the revenue growth of the preceding quarter. Thus, two-thirds of all revenue growth ? natural or due to tax hikes ? would go to deficit reduction.

Republicans are unwilling to pull the trigger on default by refusing to raise the debt limit. But a bill to allow gradual increases in the debt limit, at a pace slower than revenue growth, need not trigger default. Instead, the president would be forced to prioritize his spending and borrowing so as to avoid default, pay the military and send out Social Security checks. All the rhetorical handles he has to battle an effort to kill the debt limit increase will be gone in the face of a phased in debt limit hike.

A spending deal with deficit reduction targets really cannot be enforced. But if those goals are linked to the debt limit, they are self-enforcing.

Obama wants to not only raise the debt limit but to eliminate it. Without a debt limit, there is no way to stop or even to slow government borrowing. The two normal constraints on public debt growth are not applicable. For other borrowers, lenders can refuse to lend. But the federal government is not planning to borrow from lenders. It will borrow the money it prints and gives to banks in return for worthless mortgage backed securities. And, in usual circumstances, the interest rate rises as the debt becomes larger and less sustainable. But with the fund for debt service coming from the federal printing press, the Treasury can hold the interest rates to an artificial level of 3.5 percent as at present.

It is only through debt limits that there is any check on federal borrowing or, even on federal spending. We need to cut off the credit card Washington uses to pay its bills.

But the all-or-nothing approach of current debt limit brinksmanship leaves false draconian choices for both the president and the Congress and, of course, rattles the markets. But if the debt limit is slated to go up enough to meet debt service and other vital needs, but not enough to give the president all the money he wants, it can be a real check on executive profligacy.

The Republicans need a financial equivalent of the flexible response doctrine Kennedy brought to U.S. defense, rejecting the massive retaliation doctrine of Eisenhower as too drastic ever to really be used. If the only option is the nuclear, then there is no option.

Obama's other option on pot: Legalize it for everyone?

Under federal law, Uncle Sam could try to block marijuana legalization in Washington and Colorado. But there's another option: President Obama could pull the US out of the marijuana wars.

With half or more Americans now favoring legalizing marijuana, President Obama has one bold option that few experts are talking about: Raising the white flag and ending the federal war on pot.

To be sure, many legal experts believe the US Department of Justice instead is preparing to block new regulatory schemes passed by voters last month in Washington and Colorado that legalize and regulate the selling, possession, and use of marijuana. One option is to invoke Article 6 of the Constitution, which says federal law is "the supreme law of the land."

But despite the constraints of the 1970 Controlled Substances Act in which Congress cemented its stance that marijuana is highly dangerous and has no legitimate medical use, the Obama administration does have legal authority to relabel marijuana as either a less dangerous drug or, as Washington and Colorado have done, classify it alongside alcohol as a legal drug. Such a move could partially or wholly end federal marijuana oversight.

"Maybe this will be the moment when the feds are prepared to revisit marijuana prohibition," says Josh Meisel, co-director of the Humboldt Institute for Interdisciplinary Marijuana Research in California. "At the federal level ? I could see a scenario of marijuana regulation" ending.

At the very least, Washington and Colorado have laid a Gordian knot on the President's desk.

How, exactly, does the US respond, given that a recent Gallup poll finds that 63 percent of Americans want the federal government to leave the two states alone? Moreover, legal experts say, the laws are not at their core contradictory to federal policy.

Both state schemes will continue to regulate marijuana in ways designed to curtail, not promote, its use. In Colorado's case, tax revenues will go to local school districts. In Washington, police will be able to pull over stoners and prosecute them for intoxicated driving if they've had too much to smoke.

The legal issues are complex, and any response by the Obama administration could have broad policy repercussions on everything from enforcement priorities to how it would affect international antidrug treaties.

"Should the Justice Department prevail, it would raise the possibility of striking down the entire initiatives on the theory that voters would not have approved legalizing the drug without tight regulations and licensing similar to controls on hard alcohol," writes the New York Times' Charlie Savage.

So far, the only action the federal government has taken is US Attorney Jenny Durkan's stern warning to Washington residents that "growing, selling, or possessing any amount of marijuana remains illegal under federal law."
